DS, two pages, 8.5 x 11, February 8, 1941. Loew's Incorporated document concerning the use of Kern's name in the film Lady Be Good, in part: "I hereby consent to the use of my name in your photoplay, which is tentatively entitled 'Lady Be Good,' in connection with the action and dialogue substantially as follows: When screenplay character Eddie Crane (a song writer) is discouraged about finding someone to write the lyrics for his new tune, he says to his girl friend Dixie Donegan—'You don't understand, Dixie…You gotta work with somebody steady until you've built up a style and quality that's recognizable. Look at George Gershwin—he had his brother Ira. And there's Rogers and Hart—and Kern and Hammerstein—and—and—well, what's the difference, there are a dozen more. They work together. One helps the other and they go places!' Later when screenplay character Max Palney (song publisher) is speaking at a banquet honoring Eddie Crane and Dixie Donegan, he says—'On these occasions, in the past, we have honored such beloved members as—Victor Herbert, George Gershwin, Jerome Kern and Irving Berlin. This is our opportunity to show our appreciation to these members who have helped make the Song Writers and Publishers Protective Association the truly great organization it is!'" Boldly signed at the conclusion by Kern to consent to the use of his name; also signed by an attorney on behalf of Oscar Hammerstein II. In fine condition.
