Description

“The Execution Law of Kentucky is substantially the same as that of Virginia”

ALS signed “H. Clay,” one page, 7.75 x 10, March 14, 1836. Clay writes John S. Peer. In full: “In reply to your letter of the 12th inst. I have to state that the Execution Law of Kentucky is substantially the same as that of Virginia, in regard to the inquiry which you make, that is; that the first execution delivered to the Sherriff [sic] or officer binds the property of the debtor, and that the distinction in this respect is made in behalf of residents to the predjudice [sic] of non-residents. Mr. Richard Pindell of Lex[ington] (K)[entucky] is an Att[orney] whom I can recommend to you.” Covered in removable clear plastic and matted to an overall size of 20.5 x 15. In very good condition, with creasing, wrinkling, intersecting horizontal and vertical folds with some separation, and scattered toning and soiling. The integral page bears an address panel written by Clay with the upper right corner (once carrying the free frank) removed.

The Alamo had fallen less than a week before when Clay—who this same month had opposed the annexation of Texas by the United States—responds to a question on real estate law in the Commonwealth of Kentucky. He had longed opposed the annexation of Texas, fearing it would inject the slavery issue into politics. Despite world events, as a legislator, Clay also found himself addressing considerably less controversial matters. Pre-certified John Reznikoff/PSA/DNA and RRAuction COA.
