Defending a client’s indictment “to commit a bodily injury”

Lengthy unsigned document in Lincoln’s hand, one pale blue page, 7.75 x 12.25, October 12, 1852. A legal brief, comprising approximately 25 lines of text, filed in Platt County, Illinois. In part: “James H. Hollingsworth, the defendant to a certain indictment … for a supposed assault with intent to commit a bodily injury upon one Jacob Ater … states on oath that he can not safely go to trial at the present term because of the absence of James Chilcott and William Walker who are material witnesses…. He expects to prove by said witnesses that … After, threatened to kill the affiant and threw a heavy bottle at the head of this affiant, with great violence, and was rushing upon said affiant apparently to execute his threat of killing him, at the time this affiant snapped the pistol at him….” Accompanied by an early typescript from the Lincoln Library in Shippensburg, Pennsylvania.
