Lincoln handwritten legal brief from 1841

Partial ADS, signed “Fenn & Lincoln,” one page, 7.5 x 6, September 14, 1841. Legal brief written by Lincoln concerning the case between John Straw and Jesse Smith. In full “And the said defendant comes and defends the wrong and injury when where etc. and says plaintiff action now because he says that the said plaintiff’s declaration and each and every count thereof separately and the matters and things therein contained in manner and form as the same are therein stated and act forth are not sufficient in law for the said plaintiff to have or maintain his aforesaid action thereof against him, the said defendant, and thus he is ready to verify wherefore he prays judgement.” Some light ink spotting to left edge, horizontal fold through signature, and a rough top edge and crease to upper right corner, otherwise fine condition.
