Hayes lengthy handwritten legal brief

ADS, signed “R. B. Hayes Notary Public,” two pages, 8 x 12.5, October 16, 1846. Hayes signed twice and filed this legal brief, which he took in his own hand, as a young practicing attorney. In part, “Deposition of Complaint. William S. Russell…deposes & says I am acquainted with the Defendants in this case and I was acquainted with their ancestor Lester Richards in his life time. Lester Richard died about November 1845 very suddenly. I was knowing to a verbal contract in which the said Lester Richards agreed to convey to Dan’l B Pierce the acre of land described in his Bill; I learned of the agreement from Richards…The sum to be paid for the acre of land was fifty dollars but I can’t say whether any time was ever set when it should be paid. At first the deed in blank was left with me to be filled up and a note was to be taken for the balance of the purchase…nothing was done about it and the blank deed was taken out of my hands. I afterwards learned from Richards that Pierce was Paying him up for the land in a running account…Pierce in the meantime had taken possession of the Lot and erected a shop…Since the death of Richards I have been appointed his Administrator and the complainant has presented to me his sworn account between him and Richards amounting to $130.39 Debt and $125.66 Credits in which list is included a credit of 50 $ for the acre of land. Sworn to before me the 13th of April 1846 and herewith filed Marked Exhibit (A). I can’t state as to all the items of Daniel Pierce’s account but I understood from Richards that Pierce had paid him money at different times…The account was allowed by me as a claim against the Estate and the balance agreed to be paid out of the assets of said Estate…William Russell.” Hayes adds: “I R. B. Hayes a Notary Public in and for the County of Sandusky and State of Ohio do hereby certify that the above named William Russell was by me first duly sworn to testify the truth, the whole truth and nothing but the truth, and that the deposition by him subscribed was reduced to writing by me and taken at the time and place specified in the Notice here ascribed.” In fine condition, with intersecting folds, notary stamp over end portion of signature.
