Superior Court Judge Padden of Chicago ordered the arrest of Al Capone on February 23, 1931. However, on April 3, 1931, he was obliged to dismiss the charge of vagrancy against the gang leader when no satisfactory complainant could be found. Capone was subsequently tried and convicted of income tax evasion, which resulted in his conviction and a sentence of 11 years in federal prison.
