Original glossy 8.5 x 6.5 silver gelatin news service photograph of Al Capone smiling and seated next to U.S. Marshal H. C. W. Laubenheimer on a train car bound for Atlanta, Georgia, and the United States Penitentiary in May 1932. On October 18, 1931, Capone was convicted of three felony counts of tax evasion and two misdemeanor counts of failing to file a tax return. He was sentenced to 11 years in federal prison, and ordered to pay court costs, a fine of $50,000, and $215,000 plus interest for back taxes. While awaiting the outcome of his appeal—which was denied—Capone was housed in Chicago’s Cook County Jail. He was eventually transferred to Atlanta’s U.S. Penitentiary in May 1932, where he spent two years before being famously relocated to Alcatraz. The reverse of the photo bears an Associated Press stamp and four affixed newspaper captions related to Capone’s imprisonment.
