Months before he is elected President, Governor FDR denies clemency to a Chinese prisoner: “There is no reason why this prisoner should receive a commutation of sentence merely because he is to return to his native country”

TLS, one page, 8 x 10.5, Executive Chamber letterhead, August 1, 1932. Roosevelt writes to H. H. Smith, Esq. In part: “I am not granting your request for a hearing in the matter of the application for executive clemency for Chung Fung, inasmuch as I am convinced it would be a fruitless trip. I … have come to the conclusion that there is no reason why this prisoner should receive a commutation of sentence merely because he is to return to his native country upon the granting of such commutation. It would not be fair to other prisoners. Obviously the financial remuneration to counsel in such matters should not in the slightest be instrumental in obtaining executive favor.” In very good condition, with usual folds, toning, and scattered soiling with a few faint spots.
