Terms and ConditionsSubmitting registration and/or placing a bid in this auction constitutes full acceptance of all of the following conditions, bidding rules, and terms of sale.
The Auction Starts NowThe auction starts as soon as you receive this catalog. The Ten Minute Rule goes into effect at 10 pm (Eastern) on Wednesday, Oct 17, 2007. The auction usually ends between 4 am–7 am (Eastern) the following morning. HoursGeneral office hours are 10 am–5 pm (Eastern), Mon–Fri; hours on the last night of the auction, Wednesday, October 17, will be dictated by the Ten Minute Rule (see below). Any item in this auction can be viewed in our offices during normal business hours. Please call to set up an appointment. The Ten Minute RuleThe final day of bidding for all lots is Wednesday, October 17. Any bidder may bid on any lot prior to 10:00 pm (Eastern). At that time, the Ten Minute Rule goes into effect. IF YOU HAVE NOT BID ON A LOT BEFORE 10 pm, YOU MAY NOT BID ON THAT LOT AFTER 10 pm (the best way to succeed in the auction is to place your bids prior to 10 pm). Only those bidders who have placed bids on a lot prior to 10 pm will be allowed to bid on that lot after 10 pm. Hence, if you are the only bidder on a lot at 10 pm, that lot is awarded to you. ALL UNOPENED LOTS AT 10 pm ARE AVAILABLE TO BIDS FROM ALL BIDDERS. Bidding continues on all remaining lots until approximately 10 minutes have passed without any bidding activity on any lot. The ten minute clock does not monitor bidding activity on a per lot basis; the clock watches bidding activity for the entire auction. Every time a bid is placed, on any lot, the clock is reset and the ten minute count restarts. R&R reserves the right to close the auction at its sole discretion at any time. RegistrationYour bidder number will remain the same, but you must register to bid in each auction, even if you may have already participated in the past. We confirm your name, address, phone number, and email. We also ask you for the method of payment that you intend to use if you are successful. Please provide any address or payment changes, or any special shipping requests, before the close of the auction. New BiddersBidders without a bidder number must apply for one before they can participate in the auction. Fill out a New Bidder Application form, or request a form by mail or fax. Your bidder number can only be issued after all information has been verified. Minimum BidsEvery item has a minimum bid, abbreviated (MB). No bids will ever be accepted below these amounts. Bid IncrementsIf you want to bid on an item, you must raise its current high bid by at least 10%. Items under $50 must be raised in $5 increments. Checking BidsYou can open, check on, and/or raise bids as often as you wish, however all bidding is governed by the 10-minute rule (http://www.rrauction.com/10MR.cfm), which goes into effect at 10 pm ET on the last day of the auction. Maximum BidsTo maximize your chance of winning, please put maximum bids on items you really want. Suppose an item you want currently has a high bid of $100. Your bid would then be $110 (10% over $100), and you could tell us, “I’d like a maximum bid of $242 for that item.” We will enter your bid at $110 and we will bid for you until the lot reaches your maximum of $242. If competitive bids only reach $148 you would win it for $163 — 10% over the highest bid. To prevent tie bids, all maximum bids should also be made in proper increments. Maximum bids are strictly confidential. Placing arbitrary, non-incremental bids on lots with prior maximum bids on them may force these lots to be sold for less than 10 percent above the underbidder’s bid. Call BacksR&R offers a “call back” service on auction night for any bidder who has the high bid on an item whose current bid is over $1,000 and has a maximum bid placed. We will call you if your maximum bid is topped. We will need your correct telephone number(s) where you can be reached until the auction closes. Call backs will begin after 10:00pm on auction night and you must request this service: it is not automatic. We will make every effort to ensure that those bidders requesting a call back service will be contacted if outbid, however we do not guarantee this service. Withdrawing BidsYou are obligated to honor any bid(s) you make, and no bids may be withdrawn at any time. There will be no exceptions; failure to comply will terminate all future bidding. Placing BidsBy placing a bid or otherwise participating in the auction, you are accepting these Terms and Conditions. You are agreeing to the alternative dispute of arbitration. Arbitration replaces the right to go to court, including the right to a jury trial. If any dispute arises regarding payment, authenticity, grading, description, provenance, or any other matter pertaining to the Auction, the Bidder or a participant in the Auction and/or R&R agree that the dispute shall go to binding arbitration in accordance with the commercial rules of the American Arbitration Association. A.A.A. Arbitration shall be conducted under the provisions of the Federal Arbitration Act with locale in New Hampshire. Any claim made by a bidder has to presented within one (1) year or it is barred. The prevailing party may be awarded reasonable attorney’s fees and costs. An award granted in arbitration is enforceable in any court of competent jurisdiction. Winner NotificationWe will notify all winners by phone, fax, or email by 5 pm Friday, October 19. We will resume answering telephone calls starting at 10:00 am Monday, October 22. Auction results are available online as a PDF, and in the back of each catalog. GuaranteesEach signed item is unconditionally guaranteed genuine without time limit. If a lot is declared to be not authentic, we may ask the purchaser to supply the written opinion of one competent authority acceptable to us. We will refund the purchase price after documentation has been submitted. The buyer’s only remedy under this guarantee is the cancellation of the sale and the refund of the purchase price. This guarantee does not apply to non-autographed items. ReturnsEvery item is cataloged with the intent of accuracy. Improperly described items must be returned within three days of receipt. Please call us before returning any items. A merchandise credit will be issued in the case of a subjective, unresolvable dispute over condition. Returns of non-autographed items must be made within thirty days of the closing date of this auction (no exceptions). Returns after that date will not be accepted for any reason. Credit cards and PayPal are only accepted up to $5,000 without prior arrangements; please contact Kay Burris. Make checks or money orders payable to R&R Enterprises. Payment for non-credit card orders must be sent upon winning notification. Failure to comply with this policy will void your return privileges and will adversely affect your customer status. Personal and business checks are accepted, but for new bidders winning $500 or more, we wait 21 calendar days for checks to clear. Returned checks will be subject to a $25 Telecheck fee. Orders paid by bank check or money order are shipped upon receipt of payment. Credit card orders will be shipped first. Overseas orders must be paid by credit card. Terms of SaleA 20% buyer’s premium will be added to each winning bid, with a 2% discount for those paying by cash, check, or money order (we must know how you will pay prior to bidding!). You are obligated to honor any bid(s) you make and you authorize us to charge your credit card for any unpaid winnings. Invoices not paid within 30 days of the auction may incur a 1.5% per month late fee. In the event you fail to pay all amounts due, R&R reserves the right to resell the merchandise, and will hold you responsible for the costs of resale, including a 10% sellers commission, and also any difference between the resale prices and the price of the your successful bid. ConsignorsConsignors are not allowed to bid on or withdraw their own lots. We will contact all consignors via mail, fax, or email with their tentative final results the day after the auction ends. R&R may extend advances to certain consignors upon request. SellerR&R reserves the right to: (a) remove any item, (b) reject any bid, and (c) ban anyone from participating in this auction for any reason. We reserve the right to the final decision in all matters regarding this auction. PostponementR&R reserves the right to postpone the auction for a reasonable period of time as the result of any significant event (i.e. an Act of God, etc). In this unlikely event, bidders and consignors will be notified of the new closing date. ConditionEach item in the catalog is described with a statement indicating its overall condition. The condition of the items we offer generally falls into the following range: good—very good—?ne—very ?ne—excellent. Treated as a scale of 1 to 5, good describes an item that has as many as several ?aws, which are described in detail; excellent describes an item whose condition and appearance may be regarded as ?awless and superior in every respect. Most of the items we offer are in ?ne condition, meaning that there are no serious ?aws. While we make every effort to describe ?aws that materially affect appearance and value, we generally do not specify minor or routine ?aws, such as (but not limited to) pencil or secretarial notations, mailing folds to letters, normal aging to paper, or tiny bends or creases from normal handling. We encourage prospective bidders to examine the image(s) of each item closely and to contact us with speci?c inquiries regarding condition. Group LotsIn descriptions of group lots of two or more items, every effort is made to mention any obvious flaws. Bidders should note that group lot condition is given as a general statement or as a range, and that specific flaws to single items within the group may be omitted in the interest of catalog space. Questions about group lots, as well as about specific items within the group, should be addressed before the close of the auction to Kay Burris (kay@rrauction.com). Matted & FramedMany of the items offered for sale in each of our monthly auctions are described as matted and framed. We do not remove items from frames; the given dimensions of items housed in a frame and/or mat indicate the sight size only. Photographs used with matted and framed items are not subject to description, condition statements, nor are they considered a reason for return. We do not remove the item from the frame. Condition refers only to the item and not the mat or frame. Our terms of return apply only to the item and not the matting and framing. Any item that is removed from the frame cannot be returned. Returns are only accepted when there is an authenticity question or the description of the item is incorrect. Shipping Charges & Oversized Items
