Roosevelt wrote this letter just 11 days after winning the 1936 United States presidential election, which was held on Tuesday, November 3, 1936. In the midst of the Great Depression, incumbent Democratic President Franklin D. Roosevelt defeated Republican Governor Alf Landon of Kansas in what was the greatest electoral landslide since the rise of hegemonic control between the Democratic and Republican parties in the 1850s. By winning 523 electoral votes, Roosevelt received 98.49% of the electoral vote total, which remains the highest percentage of the electoral vote won by any candidate since 1820.
In 1938, President Roosevelt appointed Conger to serve as a judge of the United States District Court for the Southern District of New York in Manhattan. Among prominent matters before Judge Conger were cases arising from the United States Senate’s contempt citation of notorious underworld figure Frank Costello and other criminal trials of smugglers, gamblers, and narcotics dealers.
